Acceptable Use Policy

Violation of this Acceptable Use Policy may result in immediate suspension or termination of your services without refund. We reserve the right to take any action necessary to protect our network and other customers.
1. Purpose
This Acceptable Use Policy (AUP) defines the acceptable and prohibited uses of TheVPS services. This policy is designed to protect TheVPS, our customers, and the internet community from irresponsible, abusive, or illegal activities. All users of TheVPS services must comply with this AUP.
2. Illegal Activities
You may not use our services for any illegal purpose or in violation of any laws. Prohibited activities include but are not limited to:
- Distribution of child sexual abuse material (CSAM)
- Terrorism-related content or activities
- Drug trafficking or sale of controlled substances
- Human trafficking or exploitation
- Money laundering or financial fraud
- Identity theft or impersonation
- Sale of counterfeit goods or services
- Violation of export control regulations
3. Network Abuse
The following network abuse activities are strictly prohibited:
- DDoS Attacks: Launching or participating in denial-of-service attacks
- Network Scanning: Unauthorized scanning or probing of other systems
- Hacking: Unauthorized access to computer systems or networks
- Spoofing: IP address spoofing or forging packet headers
- Botnets: Operating or participating in botnets
- Traffic Hijacking: BGP hijacking or route manipulation
- Amplification Attacks: DNS, NTP, or other amplification attacks
4. Email and Spam
Email abuse is strictly prohibited:
- Sending unsolicited bulk email (spam)
- Operating open mail relays
- Email bombing or mail flooding
- Forging email headers or sender information
- Harvesting email addresses without consent
- Sending phishing emails or malicious attachments
All commercial email must comply with CAN-SPAM Act requirements and include valid unsubscribe mechanisms.
5. Malicious Software
You may not use our services to:
- Host, distribute, or develop malware, viruses, or ransomware
- Operate command and control (C2) servers
- Host exploit kits or vulnerability scanners
- Distribute cracking tools or password stealers
- Host phishing pages or credential harvesting sites
- Store or distribute stolen data or credentials
6. Intellectual Property
You must respect intellectual property rights:
- Do not host or distribute pirated software, movies, music, or games
- Do not operate torrent trackers for copyrighted content
- Do not host warez sites or crack repositories
- Respect DMCA takedown requests
- Do not circumvent DRM or copy protection
We comply with the Digital Millennium Copyright Act (DMCA) and will respond to valid takedown notices.
7. Prohibited Content
The following types of content are prohibited:
- Child sexual abuse material (zero tolerance)
- Content promoting violence or terrorism
- Defamatory or libelous content
- Content that violates privacy rights
- Fraudulent or deceptive content
- Content that promotes hatred or discrimination
8. Resource Usage
Fair use of shared resources is required:
- Do not consume excessive CPU, memory, or I/O resources that impact other customers
- Do not run cryptocurrency mining operations without explicit permission
- Do not run Tor exit nodes without prior approval
- Do not operate open proxies or VPN endpoints for abuse
- Respect bandwidth allocations and fair use limits
9. Security Requirements
You are responsible for:
- Keeping your software and systems updated
- Using strong passwords and authentication
- Securing your server against unauthorized access
- Monitoring your server for compromise or abuse
- Promptly addressing security vulnerabilities
- Responding to abuse reports within 24 hours
10. Enforcement
Violations of this AUP may result in:
- Warning: First-time minor violations may receive a warning
- Suspension: Services may be suspended pending investigation
- Termination: Serious violations result in immediate termination
- Legal Action: We may report illegal activities to law enforcement
- No Refund: Termination for AUP violations is not eligible for refund
